Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Easy BG Remover platform, including easybgremover.com, related applications, and services (collectively, the "Service"). By accessing or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and Account Registration

Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or purchase paid plans. By using the Service, you represent that you meet these requirements.
Account Information: You agree to provide accurate, current, and complete information during registration and to keep it updated.
Account Security: You are responsible for safeguarding your credentials and for all activity that occurs on your account. Notify us immediately at support@easybgremover.com if you suspect unauthorized access.

2. Service Description

Easy BG Remover provides AI-powered tools to remove backgrounds from images and create professional transparent backgrounds for e-commerce, design, and marketing applications. We may introduce new features, limit existing features, or discontinue parts of the Service at any time. Some functionality may be marked beta or preview and may be subject to additional terms.

3. Acceptable Use

You agree to:

Comply with applicable laws and regulations.
Respect intellectual property and privacy rights of others.
Upload only content that you have the right to use, store, and modify.

You agree not to:

Reverse engineer, decompile, or otherwise attempt to extract source code or underlying models.
Circumvent usage limits, quotas, or authentication mechanisms.
Upload content that is unlawful, exploitative, hateful, or otherwise violates our policies.
Use the Service to develop competing products that replicate core functionality.
Interfere with or disrupt networks, infrastructure, or other users’ ability to access the Service.

We reserve the right to monitor compliance and suspend or terminate accounts that violate these Terms.

4. Ownership and License

Your Content: You retain ownership of images, prompts, metadata, and outputs you upload or generate. You grant Easy BG Remover a limited license to process that content solely to provide the Service and improve quality safeguards (e.g., abuse detection, edge detection accuracy). You may delete content at any time; residual backups will expire within standard retention windows.
Our Technology: All software, AI models, interfaces, templates, and documentation are owned by Easy BG Remover or its licensors. Except for the limited rights expressly granted, no licenses or rights are transferred to you.
Feedback: If you provide suggestions or feedback, we may use it without obligation or compensation.

5. Plans, Billing, and Taxes

Subscriptions: Paid plans auto-renew until cancelled. You may cancel via your account dashboard; cancellations take effect at the end of the current billing cycle.
Fees: You agree to pay all fees displayed at checkout. Prices may change; we will notify you in advance of increases. Continued use after the effective date constitutes acceptance.
Refunds: Except where required by law, fees are non-refundable. If the Service is materially unavailable for more than 24 consecutive hours due solely to our infrastructure, contact support for credit review.
Taxes: You are responsible for applicable taxes, duties, and government charges. We will collect tax where required and itemize it on invoices.

6. Third-Party Services

The Service may integrate with third-party platforms (e.g., storage providers, analytics tools). Your use of those services is governed by their terms. We are not responsible for third-party services or data handling once you export content to them.

7. Confidentiality

If you access non-public features, beta programs, or confidential information, you must protect that information with at least reasonable care and use it solely for evaluating the Service. This obligation survives termination.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately if you breach these Terms, use the Service in a manner that risks harm, or as required by law. Upon termination, your right to use the Service ceases immediately, but sections meant to survive (including Sections 4, 5, 7–13) will remain in effect.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." EASY BG REMOVER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASY BG REMOVER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EASY BG REMOVER FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $100.

11. Indemnification

You will indemnify and hold harmless Easy BG Remover, its affiliates, and their officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your content, your use of the Service in violation of these Terms, or infringement of third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any dispute will be resolved through binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association, conducted in English in Wilmington, Delaware. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

13. Changes to the Terms

We may modify these Terms by posting the updated version with a new effective date. If changes are material, we will provide reasonable advance notice via email or in-app messaging. Your continued use after the effective date constitutes acceptance.
